1. Acceptance of Terms
These Terms of Service ("Terms") constitute a legally binding agreement between you and Dexascans.com ("Company," "we," "our," or "us") governing your access to and use of our website at www.dexascans.com and our body composition and bone density scanning services (collectively, the "Services"). By accessing our website or scheduling, attending, or receiving a scan, you confirm that you have read, understood, and agree to these Terms.
2. Description of Services
Dexascans.com provides dual-energy X-ray absorptiometry (DEXA) scans for body composition analysis (measuring body fat percentage, lean mass, and visceral fat) and bone mineral density assessment at our network of clinic locations. Our Services are intended for wellness and health monitoring purposes and are available to adults 18 years of age and older without a physician referral, unless otherwise required for insurance billing purposes.
3. Medical Disclaimer
Dexascans.com does not provide medical advice, diagnosis, or treatment. The information and results provided through our Services — including body fat percentage, lean mass measurements, visceral fat scores, and bone density T-scores — are for general informational and wellness monitoring purposes only. They are not a substitute for professional medical advice, diagnosis, or treatment by a qualified healthcare provider.
Always consult a qualified physician or other licensed healthcare professional with any questions you may have about your health, body composition results, or bone density findings. Do not disregard, delay, or discontinue seeking medical advice because of information received through our Services. DEXA scan results should be interpreted in the context of a comprehensive clinical evaluation.
4. Eligibility and Contraindications
Our Services are available to individuals 18 years of age or older. You may not be eligible for or should consult your physician before scheduling a DEXA scan if you:
- Are pregnant or may be pregnant
- Have had a nuclear medicine scan or barium contrast study within the past 7 days
- Are unable to lie still for 10–15 minutes during the scanning procedure
- Weigh more than 300 lbs (136 kg), which exceeds the table weight limit on standard DEXA equipment
It is your responsibility to disclose relevant health information when scheduling and at your appointment. We reserve the right to decline to perform a scan if contraindications are identified or if doing so would not be safe or appropriate.
5. Appointments, Cancellations, and Fees
Appointment fees are due at the time of service. We accept major credit cards, debit cards, HSA/FSA cards, and cash. We do not bill insurance directly; however, we can provide itemized receipts for self-submission to insurance or HSA/FSA accounts.
We ask that you cancel or reschedule appointments at least 24 hours in advance. Late cancellations or no-shows may be subject to a cancellation fee of up to the full appointment cost. We reserve the right to charge the payment method on file for applicable fees.
6. Accuracy of Results
DEXA scanning is the clinical gold standard for body composition and bone density measurement; however, no measurement technology is 100% precise. Results may be influenced by factors including recent food or fluid intake, exercise, medication use, and equipment calibration. We perform regular equipment maintenance and quality assurance protocols to ensure the accuracy of our measurements, but we cannot guarantee that results will be free from all measurement variability.
To maximize result consistency across sequential scans, we recommend scanning at the same time of day, in a similar state of hydration, and on the same or similar equipment.
7. Intellectual Property
All content on the Dexascans.com website — including text, graphics, photographs, logos, and the selection and arrangement of content — is the property of Dexascans.com or its content suppliers and is protected by applicable copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any content on this website without our express written permission.
8. Limitation of Liability
To the fullest extent permitted by applicable law, Dexascans.com and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of, or inability to use, our Services or website — including but not limited to decisions made based on DEXA scan results, whether or not we have been advised of the possibility of such damages.
Our total liability to you for any claim arising out of or relating to these Terms or our Services shall not exceed the amount you paid us for the specific Service giving rise to the claim.
9. Indemnification
You agree to indemnify, defend, and hold harmless Dexascans.com and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with your use of our Services, your violation of these Terms, or your violation of any rights of another person or entity.
10. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any dispute arising out of or relating to these Terms or our Services that cannot be resolved informally shall be submitted to binding arbitration in San Diego County, California, under the rules of the American Arbitration Association, except that either party may seek injunctive or other equitable relief in any court of competent jurisdiction.
11. Changes to These Terms
We reserve the right to modify these Terms at any time. When we make material changes, we will update the "Last updated" date at the top of this page. Your continued use of our Services after changes become effective constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically.
